1. General provisions

1.1. This Agreement defines the terms of use by Users (Buyers) of materials and services of the website https://gadgetguys.com.ua or https://www.gadgetguys.com.ua (hereinafter referred to as the Site, website, online store)

1.2. This agreement, in accordance with Art. 633, Art. 641 and Section 63 of the Civil Code of Ukraine, is a public contract (offer) and is addressed to an indefinite number of persons regardless of status (individual, legal entity, individual entrepreneur), who wish to purchase goods in the online store https://gadgetguys.com.ua or https://www.gadgetguys.com.ua . Sellers of goods may be other third parties (not the Administration) who use the services of gadgetguys.com.ua to sell their goods on the Internet. Information about such sellers is provided by the Administration at the request of the User (Buyer)

1.3. Since this Agreement is a public offer, by gaining access to the materials of the Site, the User (Buyer) is considered a party to this Agreement.

1.4. The Site Administration (the owner of the site https://gadgetguys.com.ua or https://www.gadgetguys.com.ua and/or persons authorized by him) has the right to unilaterally change the terms of this Agreement at any time. The new or amended Agreement shall become effective after its posting on the Site. If the User disagrees with the changes made, he is obliged to refuse access to the Site and stop using the materials and services of the Site.

1.5. The Buyer agrees to this public offer in its entirety and without reservations when placing an Order on the Site.

1.6. The Visitor (Buyer) agrees that all terms of the User Agreement are understandable to him and he accepts them fully and unconditionally.

2. Registration on the Site

2.1. To place orders on the Site, the User (Buyer) can complete the registration procedure and provide the necessary data according to the questionnaire.

2.2. When registering on the Site, the User (Buyer) undertakes to provide reliable and accurate information about himself and his contact details so that the Site Administration can fulfill its obligations to the User (Buyer) and deliver the paid Goods to him.

2.3. During the registration process on the Site, the User (Buyer) specifies a login (his e-mail) and password, for the security of which he is responsible. The User (Buyer) undertakes not to disclose to third parties the login and password specified during registration, to store this data in a place inaccessible to third parties. The Buyer is solely responsible for all actions taken on his behalf, that is, using his login and password.

3. Privacy and personal data

3.1. The information provided by the User (Buyer) is confidential. The site administration uses information about the User (Buyer) for the purpose of fulfilling the Visitor's (Buyer's) Orders, unless other purposes are specified in this Agreement.

3.2. By filling out the registration form on the website https://gadgetguys.com.ua or https://www.gadgetguys.com.ua, the Visitor (Buyer) voluntarily consents to the collection and processing of his/her personal data by the Site Administration for the following purpose: the information provided by the Visitor (Buyer) during registration on the Site will be used to process Orders for the purchase of Goods, receive information about orders, send advertising and special offers by telecommunication means (e-mail, mobile communication), information about promotions, raffles or any other information about the activities of the Website https://gadgetguys.com.ua or https://www.gadgetguys.com.ua, for other commercial purposes.

3.3. For the purposes provided for in this clause, the Administration has the right to send letters, messages and materials to the postal address, e-mail of the Visitor (Buyer), as well as to send SMS messages, make calls to the number specified in the questionnaire, if this is necessary to fulfill the User's (buyer's) order. The Administration has the right to record telephone calls with the Visitor (Buyer) in order to improve the quality of the latter's service, to which the Visitor (Buyer) gives his/her unconditional consent.

3.4. The Visitor (Buyer) agrees to the use of cookie technology by the Administration. Cookies do not contain personal information and cannot in any way read information from the Visitor's (Buyer's) hard drive. Cookies are used to improve the quality of the services provided, in particular for quick identification of the Visitor (Buyer), saving the Visitor's (Buyer's) settings, his/her personal preferences, tracking the status of the Visitor's (Buyer's) access session and trends characteristic of him/her. The Administration also uses cookies for advertising purposes, in particular to manage advertisements on websites on the Internet. After the Visitor (Buyer) disables cookie technology, the Administration does not guarantee the full functionality of the website https://gadgetguys.com.ua or https://www.gadgetguys.com.ua or some of its services.

3.4. The Buyer grants the Administration the right to process his personal data, in particular to place personal data in the Administration's databases (without additional notification thereof), to carry out lifelong storage of data, their accumulation, updating, modification (if necessary). The Administration undertakes to ensure data protection from unauthorized access by third parties, not to distribute or transfer data to any third party (except for the transfer of data to related parties, commercial partners, persons authorized by the Administration to directly process data for the specified purposes, as well as upon mandatory request of a competent state body).

3.5. If the Visitor (Buyer) does not wish to receive newsletters about promotions, new products, etc., he/she has the right to refuse it by sending a letter to the Administration and/or indicating the appropriate mark in his/her personal account.

3.6. The Administration is not responsible for the content and reliability of the information provided by the Visitor (Buyer) during registration on the website https://gadgetguys.com.ua or https://www.gadgetguys.com.ua and placing an Order. The Visitor (Buyer) is responsible for the reliability of the information specified during registration on the website and placing an Order, and agrees to all risks associated with the unreliability of such information.

4. Order processing procedure, pricing, exchange.

4.1. The Visitor (Buyer) can place an order independently by clicking the "buy" and "place order" buttons or by calling the number indicated at the top of the page. After placing an order, the buyer will be sent a message confirming the order to the contacts specified during the order process and the availability of the goods or the estimated date of receipt of the goods in case of their absence. When placing an order by phone, the message will be made via telephone.

4.3. In the event of the absence of the product specified on the Site due to technical difficulties, as well as for other reasons beyond the control of the Administration, the specified order is canceled in whole or in part, and the Visitor (Buyer) is informed by sending him a message.

4.4. By entering into this Agreement and placing an order, the User (Buyer) confirms that he/she is familiar with the sections of the Site "Delivery and Payment", "About the Store", agrees with them and fully understands them. The Administration reserves the right to change the delivery date of the order with appropriate notice to the user.

4.5. The Visitor (Buyer) agrees that the price of the goods added to the "basket", its assortment and quantity will be relevant only at the time of formation of the "basket" and may change if the purchase has not been finally completed by clicking the "place order", "buy" button.

4.6. The Visitor (Buyer) agrees that the Goods purchased by him are not subject to exchange or return in the following cases:

4.6.1. More than 14 calendar days have passed since the purchase of the Goods;

4.6.2. 14 calendar days have not passed since the moment of purchase of the Goods, but the Goods were in use, the integrity of the packaging and/or completeness was violated, tags/price tags are missing, etc.

4.6.3. The Visitor (Buyer) refuses to provide photo or video materials of the defective and/or faulty, in his opinion, goods.

4.6.4. The Visitor (Buyer) confirms his/her awareness that promotional codes or certificates cannot be exchanged for cash equivalent, can be used once and, if used, the difference between the denomination of the certificate and the order amount is not compensated.

4.6.5. The Visitor (Buyer) confirms his/her awareness that when returning a product that was partially or fully paid for using a certificate code, the monetary equivalent of the certificate's face value is not returned, the certificate code is automatically restored and considered unused.

4.7. By this Agreement, the User (Buyer) confirms his/her awareness that only new goods that have not been used and have no traces of use: scratches, chips are subject to exchange or return; the following must be preserved: the complete set of goods, the integrity and all components of the packaging, labels, factory marking, and the Visitor (Buyer) has the original document confirming the fact of purchase of the relevant Goods. Violation of any of these points reserves the right for the Administration to refuse the Visitor (Buyer) the exchange or return of the goods.

4.8. All payments for purchased goods are made in accordance with the current legislation of Ukraine. Payment is made to the official account of the entrepreneur (individual entrepreneur Stavsky Vadim Valentinovich), which guarantees the transparency and legality of financial transactions.

4.9. When ordering goods on the website, the User (Buyer) confirms his/her consent to receive information about the date of production, shelf life of the products in the format provided by the manufacturer, in particular using the Batch Code printed on the product packaging or other manufacturer markings.

4.10. When ordering goods on the website, the User (Buyer) confirms his consent to the combination of orders placed for one recipient in one package and receipt in one parcel. In the event of combining orders, the User (Buyer) will be notified by means of a message to the e-mail address specified during the order process.

4.11 If the Visitor (Buyer) refuses the goods, the Administration shall refund the amount paid by the Buyer, excluding the Seller's costs for delivery of the returned goods from the Buyer.

5. Limitation of liability of the Administration

5.1. The Administration does not bear any responsibility for any errors, typographical errors and inaccuracies that may be found in the materials contained on this website. The Administration makes every effort to ensure the accuracy and reliability of the information on the website of the Online Store. All information and materials are provided on an "as is" basis, without any guarantees, both express and implied.

5.2. The Administration bears no responsibility for the statements and opinions of Visitors (Buyers) of the website left as comments or reviews.

5.3. The Administration is not responsible for possible unlawful actions of the Visitor (Buyer) against third parties or actions of third parties against the Visitor / Buyer.

5.4. The Administration is not liable for any damage, loss or expense (actual or potential) arising in connection with this website, its use or inability to use it.

5.5. The Administration is not responsible for the User's (Buyer's) loss of access to his/her account - an account on the website https://gadgetguys.com.ua or https://www.gadgetguys.com.ua (loss of login, password, other information).

5.6. For the purpose of the above, the Administration reserves the right to delete information posted on the Site and take technical and legal measures to terminate access to the Online Store of users (Buyers) who create problems in the use of the Online Store by other Visitors (Buyers), Users (Buyers) in the event of any unscrupulous abuse on their part when ordering goods that are not intended to be purchased, or Visitors (Buyers) who violate the requirements of the Agreement. In this case, such blocking occurs at the discretion of the Administration without further notification of such Users (Buyers)

5.7. The website administration is not responsible for:

5.7.1. Delays or failures in the process of carrying out the transaction arising from force majeure, as well as any case of disruptions in telecommunications, computer, electrical and other related systems.

5.7.2. Actions of transfer systems, banks, payment systems and for delays associated with their work.

5.7.3. Proper functioning of the Site if the Visitor (Buyer) does not have the necessary technical means to use it, and also does not bear any obligations to provide users with such means.

6. Exclusive rights

6.1. All objects accessible through the services of the Site https://gadgetguys.com.ua or https://www.gadgetguys.com.ua, including design elements, text, graphic images, illustrations, videos, computer programs, databases, music, sounds and other objects (hereinafter referred to as the content of the services), as well as any content posted on the website https://gadgetguys.com.ua or https://www.gadgetguys.com.ua, are the objects of exclusive rights of the Administration, users and other right holders.

6.2. Use of content, as well as any other elements of the services, is possible only within the framework of the functionality offered by a particular service. No elements of the content of the services of the Site https://gadgetguys.com.ua or https://www.gadgetguys.com.ua as well as any content posted on the services of the Site https://gadgetguys.com.ua or https://www.gadgetguys.com.ua may be used in any other way without the prior permission / consent of the copyright holder. Use refers to reproduction, copying, processing, distribution on any basis, display in a draw, etc. The exception is cases directly provided for by the legislation of Ukraine. The User may use the content elements of the services, as well as any content for personal non-commercial use, provided that all copyright protection marks, related rights, trademarks, other notices of authorship are preserved, the name (or pseudonym) of the author / name of the copyright holder is preserved unchanged, and the corresponding object is preserved unchanged. The exceptions are cases expressly provided for by the legislation of Ukraine.
